A Cry For Help That Fell On Deaf (Uncaring) Ears

Dear Mr. Abbott,
I am writing this letter to ask for a review of the disturbing details of the prosecution of the case of The State of Texas vs. Terry K. Hammond, cause # 4010. A full review of the entire case, not just summaries, will reveal that a great travesty of justice through abuse of authority has been rendered.
In 2002 former Prosecutor Richard J. Roach, at the behest of Shamrock Chamber of Commerce Director David Rushing, pursued a bogus indictment of Terry Keith Hammond, the local radio station owner in Shamrock. The crux of the case was that Mr. Hammond stole money from his own radio station. As ridiculous as this may sound Mr. Roach was able to convince his assistant prosecutor, Ms. Lynn Switzer, to push this case through to a conviction - over her own initial protests! Ms. Switzer told Mr. Hammond's attorney, Henry T. Ray of Amarillo, that this case should never have been brought to trial. It has more recently come to light, from people who had sat on the original grand jury, that Mr. Roach had to make several attempts at the indictment and was only successful after “tweaking” the evidence against Mr. Hammond!
It is my opinion that Mr. David Rushing, who is Shamrock’s Chamber of Commerce Director as well as president of Shamrock’s Economic Development Corporation, wanted control of Mr. Hammond's radio station. Mr. Hammond is an outsider and it is therefore a threat to the power structure in this part of Texas to have an unencumbered form of media reporting on the day to day activities in the community. Mr. Roach, then prosecutor of Wheeler County, was fearful of the influence of Mr. Hammond and his radio station as well. Mr. Hammond would freely use his radio station to inform the public of Mr. Roach's criminal activity at the Wheeler County Courthouse (drug abuse, child pornography etc..). As a matter of fact, Mr. Hammond revealed information regarding Mr. Roach's use of methamphetamines while in the position of County Prosecutor more than a year before his prosecution. There is no doubt in my mind that this was the catalyst behind Mr. Roach’s zeal regarding the prosecution of this case. As a side note, which should add further curiosity, Mr. Hammond’s wife was also arrested for her part in cashing the alleged “stolen” check in October 2002, but to date has never been tried on these charges.
As I understand it under current Texas law criminal prosecution of a county prosecutor does not automatically trigger a review of the cases prosecuted under that person. However, in this instance, there is other criminal activity attached to the case, in addition to Mr. Roach’s abuse of power, that has gone unpunished. During 2002 Mr. Rushing forcibly removed $49,000 over a six-month period from Mr. Hammond's radio station’s revenue. He demanded the money directly from Mr. Hammond on a daily basis or else he would be forced to use the authority of the town constable, Mr. Jerry Bob Jernigan. Mr. Rushing (please see enclosed court transcript) admits to doing this under the advisement of his attorney. It is my opinion, since neither Mr. Rushing nor the Shamrock EDC ever owned any part of the radio station, that this act of taking $49,000 from Mr. Hammond's business, regardless of who gave the advice to do so, qualifies as theft and under threat of force qualifies as robbery. The sheer arrogance of Mr. Rushing's admission to a crime while on the witness stand in a Texas court of law, with impunity, bespeaks volumes about the level of corruption in this case and in this area of Texas. Mr. Rushing deposited the funds in the local National Bank of Commerce in Shamrock under an account registered as "KRMN ESCROW". Mr. Rushing later withdrew the money and spent it on new carpeting for a building downtown, dinners, and overnight stays in hotels. Mr. Hammond has cancelled checks and receipts to prove all of this. This is, in my mind, an unlawful conversion of funds.
I am, therefore, requesting a full review of the entire case as well as the suspicious and in my opinion illegal prosecution of Terry Keith Hammond. Mr. Hammond can be reached at 806-334-1210. Mr. Hammond’s attorney, Henry Ray, can be reached at 806-373-1718. In just two weeks Mr. Hammond will be forced to file an appeal and face more legal expenses and possible imprisonment. Mr. Hammond, his wife and kids and all of those concerned with their welfare are relying on the integrity of the Attorney General’s office to see that this situation is righted and that justice is served in Shamrock.
