The contract the bank "forgot" it had signed (even while they still had a copy)...

I know but, according to our collection agency, the local branch VP insisted that this contract "couldn't be in the posession of your radio station because Mr. Rushing says he physically removed it from your posession!" (Which is a crime in itself that is called "theft".)

Fortunately, Gladys Vanderpool - of the Pampa, Texas branch - remembers signing the contract... Which still gets us nowhere due to incompetence and criminal intent in the office of the district attorney.

The letter from F. C. "Sonny" Hilburn in which he finally admitted that the contract did exist...

But he then immediately begins to deny that it's with US (despite my signature at the bottom as the ultimate station authority)...

Letter from Archie Overbey (President/CEO of the bank) in which he upholds and stands behind the criminal misappropriation of our funds...

The bottom paragraph refers to a "hold" that my wife was never notified of in which she had an "available balance" of more than $1,350.00 (according to both ATM's and living bank tellers) but, before the week was out, had MANY checks in amounts of $10 and $20 returned stamped "NSF".

Of course, the bank charged her nearly $500 for this "hold" that apparently never existed but, it DID get us a reputation for passing "hot checks" within the community...

Do I really need to explain this?

This check was instrumental in having the owner of the local radio station convicted of stealing from himself.

There's absolutely NO admission of wrong-doing to be forthcoming from Sonny Hilburn & Company and they even DEMANDED that I sign a letter promising to not mention the name of their bank on the radio but, as far as I'm concerned, this is the same as a signed confession to unlawful conversion of funds. Sadly, incompetence on the part of local prosecutors (the office of the district attorney) continues to prevent the seeking of any kind of justice in the matter.

Of course, this VERY SAME CHECK check (the earlier version that the bank had denied owing and that Rick Walden has CONFESSED TO STEALING AND DELIVERING TO DAVID RUSHING) was instrumental in having the station owner convicted of stealing from himself... (Did I mention incompetence in the office of the district attorney, yet?)
