Following a very brief discussion with Shamrock Police Chief Joe Daniels on the morning of August 6, 2007, it is evident that he is under the impression a lot of the material on this site is an attempt at "slamming" the Shamrock Police Department.
This is just a quick note to advise Chief Daniels (and the rest of the world) that there has not at any time ever been any intentions of making derogatory statements against any person or entity that is untrue. I honestly cannot say that any person or representative of the Shamrock (city) Police Department has ever stepped out of line or been anything other than fair and honest with us.
There is the one matter of the false (fraudulent) affidavit that Chief Daniels personally submitted to the Federal Communications Commission in which he states that he "was at 201 North Main Street during the eviction and saw no violence" however, as Chief Daniels advised me on the morning of August 6, 2007, that he was "standing outside right over there", I will be among the first to admit that it is very difficult to see ANYTHING for "standing outside right over there" when ALL of the action (threats of violence) were occurring INSIDE the concrete walls of what was formerly a bank building and, as such, has VERY THICK walls.
Therefore, simple logic would indicate that the person issuing that statement obviously could NOT see or hear anything happening INSIDE of the building and, as a direct result of intentional omission, would be telling the truth when claiming to have seen and heard no violence during the criminal "eviction". (Let's not forget that not only was there NO legal foreclosure proceeding underway, no NOTICE OF INTENT TO EVICT - as mandated by state and federal law - but the people who were "evicted" DID NOT OWE ANY MONEY ON THE PROPERTY. How about the fact that David Rushing had been unlawfully stealing the radio station income for almost six full months at the time of the occurrence of this so-called "eviction". Further, he had told his own people (on the record at the meetings - which his friends will obviously choose to "selectively forget" - and, fortunately, on Mr. Hammond's recordings of those meetings) that "I have to take the radio station's money to be sure the radio station payments are delinquent so that we can force a foreclosure" (yet another federal trade law violation). So obviously, none of this theory holds any water at all. but, this is Shamerock and the district attorney is a confessed drug user/dealer...
For the record: Aside from the fraudulently submitted statement, no person or persons from the Shamrock (city) Police Department have EVER been anything short of cordial with any representative of the radio station.
Otherwise, the challenge remains (as it always has) for any person who would like to disprove any of the facts as published on this site to bring forth the proof and the alleged false claims will be removed. To date, the ONLY thing this has produced is the court documented testimony of both David Rushing and Rick Walden who BOTH state (under oath), "I really can't think of anything on there that's not true."
Fully, 100% of the criminal activity on the behalf of local law enforcement was by the Wheeler County Sheriff's department while AT THE DIRECTION OF RICK WALDEN who, as we have seen was so overly enamored by the drug dealing DA, that he was so completely incompetent at something so plainly simple as calling the previous station owner on a telephone in order to verify that it was indeed Mr. Turvaville's signature on the transfer application (thereby giving him the ability to LIE to a court and fraudulently claim that the license transfer was the result of fraud (in his very obviously prejudiced "professional opinion").
